ACTA in a Nutshell –

What is ACTA?  ACTA is the Anti-Counterfeiting Trade Agreement. A new intellectual property enforcement treaty being negotiated by the United States, the European Community, Switzerland, and Japan, with Australia, the Republic of Korea, New Zealand, Mexico, Jordan, Morocco, Singapore, the United Arab Emirates, and Canada recently announcing that they will join in as well.

Why should you care about ACTA? Initial reports indicate that the treaty will have a very broad scope and will involve new tools targeting “Internet distribution and information technology.”

What is the goal of ACTA? Reportedly the goal is to create new legal standards of intellectual property enforcement, as well as increased international cooperation, an example of which would be an increase in information sharing between signatory countries’ law enforcement agencies.

Essential ACTA Resources

  • Read more about ACTA here: ACTA Fact Sheet
  • Read the authentic version of the ACTA text as of 15 April 2011, as finalized by participating countries here: ACTA Finalized Text
  • Follow the history of the treaty’s formation here: ACTA history
  • Read letters from U.S. Senator Ron Wyden wherein he challenges the constitutionality of ACTA: Letter 1 | Letter 2 | Read the Administration’s Response to Wyden’s First Letter here: Response
  • Watch a short informative video on ACTA: ACTA Video
  • Watch a lulzy video on ACTA: Lulzy Video

Say NO to ACTA. It is essential to spread awareness and get the word out on ACTA.

They pulled both SOPA and PIPA, yah!

But...(and you knew there was going to be a but):
SOPA Defeat Is Not the End Of Hollywood's Ramped-Up Fight Against Piracy (Analysis)

This is what Hollywood is saying and what they are planning: push for more criminal federal and international enforcement, use the courts to get civil injunctive relief, and keeping rewriting the copyright laws in their favor. Remember the lawsuit against Youtube is still to be decided. Imagine Youtube being out out of business just like Megaupload (although Youtube is not even coming close to pulling some of the boneheaded Megaupload moves).

"SOPA protesters roundly cheered when DNS-blocking was taken out of the anti-piracy bills before Congress. But just because Congress won't explicitly approve such measures doesn't mean that they won't happen. In piracy cases going forward, Holllywood can ask sympathetic judges to grant such relief anyway."

Since I know we're in it for the long haul and that the efforts to silence speech in favor of corporate interests will continue, I plan to carry on with the SOPA Boycott in March.

Nor am I alone in coming to this conclusion:

"The MPAA studios hate us. They hate us with region locks and unskippable screens and encryption and criminalization of fair use. They see us as stupid eyeballs with wallets, and they are entitled to a constant stream of our money. They despise us, and they certainly don’t respect us.

Yet when we watch their movies, we support them....They use our support to buy these laws.

So maybe, instead of waiting for the MPAA’s next law and changing our Twitter avatars for a few days in protest, it would be more productive to significantly reduce or eliminate our support of the MPAA member companies starting today, and start supporting campaign finance reform.
More "On The Next SOPA."

I posted this in response to something in a friend's LJ, but I think I need to repeat it, because I feel incredibly strongly about it.

See, I don't ever buy something if I don't know for sure that I want it. These days, radio stations have incredibly restrictive playlists and most of them are the same anyway. They consist of the stuff that's being pushed at the moment, and most of it is (IMO) crap. About once a year I find something that made it onto the payola list that is actually bearable, but I can't hear the kinds of music I want to hear without paying for something I don't know if I like - unless I download it to listen first. Why would I buy a pig in a poke?

I buy CDs, I do. I own around 2,000 of them and counting. If I really like something I buy it. Often I'll give the artist the benefit of the doubt later and buy their new stuff without downloading first, but all that will stop if I can't hear what they do first.

I have a rec blog for indie music. IF I can't download and listen to stuff, there will be a lot of artists that will be at least one rec lighter.

Then we have TV. Canada is a third world country as far as TV is concerned. Americans have their genre shows and so on (and cancel them) often long before they air in Canada, because so much Canadian TV has to contain Canadian content... and no, SPN is not Canadian content. Canadian content is mostly real and earnest, humourless bilge that is loved by only the pretentious, or amateurish stuff that is very poorly written. There have been exceptions, but guess what! They were canceled. Bah! well, mostly. I sympathise with you guys because your plight is worse than mine.

Let's look at a show like Leverage. I love that show. When they finally started to air it in Canada - on a channel people have to pay extra for - it was starting its third season. Burn Notice is another one. If I hadn't actually seen them (by downloading them) and been caught up in them, they'd have missed out on those Blu Ray sales. They wouldn't have had my money for the merchandise, and the conventions etc.

Make them available to me for download, and it won't stop me buying them. I am not alone. I'm one of many.

And I watch Supernatural twice on a Friday, then I download it and watch it some more, and I have it all on my hard drive, but I also own all the DVDs AND the Blu Rays, and T-shirts and books and comics and I go to cons when I can, and it's what I do. I vote. I promote, I hook my friends and colleagues and I provide huge PR for the shows I love.

You too. We need to make this known to the media owning freaks that think they are missing out on cash. They'll miss out on so much more if they cut us off. However most of the time I can't even see the goddamned trailers until some kind soul takes pity and uploads them to Youtube to snare them.

We need to fight for fans everywhere.

The PCA aired last night, and SPN won two categories, including best network drama, except I hear that the boys weren't invited to the awards show, and they didn't even bother to announce it on the damned show that they won. I am really cranky. I have emailed PCA to express my frustration with this, and am asking that you do the same. It looks like they were blown off because they weren't the show that the PTB wanted to win. All I can say is that it is the PEOPLES' CHOICE, and their preferences don't count.

So please go to the PCA site and login, then write them to complain, tweet, and generally make our feelings known. The show could have gotten a boost from their appearance, and it looks as if that was screwed by the suits. Oddly, all the crappy little shows on that particular network got their moment in the sun.

Also, what the hell was wrong with Demi Lovato? She couldn't carry a tune in a bucket.

Someone please tell me why I have to work? Why doesn't someone pay me for being me, so I don't have to put up with idiot clients? Why don't people read instructions? Are most people really REALLY fucking lazy, or am I just a curmudgeon? I want to be independently wealthy so I can quit my job and go to school and learn Photoshop properly. *sigh*
/rant.

My oldest kid just phoned me to tell me that he came home from work to find that someone had ripped the lock off his door and stolen all his electronics, and all the kids' Christmas presents from the apartment upstairs. It's the second time it's happened. They did the same thing this time last year. I told him to move, but it's sickening. I guess I'm not having a great day!

I posted my Jensen the Space Detective pulp fiction, Murder by Space, and I'm pleased with it, so that was good. I'm almost done with a pinch hit for someone for Christmas, and then on Tuesday next week we're going to have our turn in the spotlight for "His Hero." That's going to be really fun.

So it's a new year, and I can say goodbye to 2011, which was not a great year for me. I've been in a bad place for a lot of it, with real life eating my time more and more with every day, but there have been achievements too, and when I got to looking at what I'd achieved I felt a little better. I will list them here, not to brag, because they're pretty modest all told, but to stand as a benchmark so I can see what to beat next year:

Accomplishments in 2011

1: Lost 60lbs
2: Made a couple of awesome new friends
3: Had an OF accepted for publication. It's out on Jan 16th!
4: wrote a couple of fics. Very few in fact. Am horribly lazy
5: Finally saw Jensen Ackles sing
6: Beta'd 52 stories.

To do in 2012

1: Get to my goal weight - another 25lbs
2: Write a little every day instead of putting it off
3: Actually post to my LJ instead of just thinking about it
4: Learn to say NO instead of just brooding
5: Learn to make animations and really get to grips with Photoshop.
